Short and to the point. These are the agreements between you and us about using Flexner.
HISLOP, Transvaalstraat 41-1, 1092 HB Amsterdam. Chamber of Commerce 64584348, VAT NL002294859B67.
Flexner is intended for business use. If you take out a subscription as a business, the consumer right of withdrawal does not apply.
Flexner records what happens on site, room by room, and lets you share what the client is allowed to see.
Flexner is not timesheets, not invoicing, not planning, and not a case file for winning a dispute. Treat it as a photo album with dates, not as legal evidence.
You're responsible for what happens under your account, and for who you invite. An invitation link grants access to anyone who opens it, so only forward it to the person you mean.
If you invite a client, it's on you that they're allowed to see what you share with them. We don't check that.
You pay monthly, per company, based on the number of projects running at once. Trades and clients are always free, however many there are.
All amounts are excluding VAT. Payment goes through Stripe.
You can cancel at any time; it takes effect at the end of the current month. You keep access until then. We don't refund a month already started.
Prices may change. We'll tell you at least 30 days beforehand; if you disagree, you can cancel before it takes effect.
What you put into Flexner stays yours. We don't use it for anything else, don't sell it, and don't train models on it.
If you stop, you can take your data with you. Ask before you delete your account. After that it's gone.
We do our best to keep Flexner working, but we don't promise uninterrupted availability. Maintenance, outages at our suppliers and your own connection on site can all mean it doesn't work for a while.
Uploads that can't get out stay on your device and go as soon as you have signal. While they're queued they exist nowhere else, so don't delete the app while something is still waiting.
Our liability is limited to the amount you paid in the preceding twelve months. For users on the free plan that means: nothing.
We're not liable for consequential loss, lost revenue or disputes with your client. That sounds harsh, but it comes with the price: don't use Flexner as the only record of something with a lot of money attached.
These limits don't apply in cases of intent or wilful recklessness on our part.
We may change these terms. For a substantive change we'll let you know before it takes effect.
Dutch law applies. Disputes go to the competent court in the Netherlands.
